Terms of Use

These Terms of Use (“Terms”) govern your access to and use of https://eclatinstitute.sg (the “Site”), which is operated by Eclat Institute (“Eclat Institute”, “we”, “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

About the Site

Eclat Institute is a tuition centre in Singapore offering small-group IP and JC tuition in Mathematics, Physics, Chemistry, and Biology. The Site provides information about our programmes and centres, educational articles and study guides, and interactive tools such as calculators and study-plan generators.

These Terms govern your access to and use of the Site only. Any tuition, enrolment, payment, attendance, make-up lesson, refund, or other education services offered by Eclat Institute are governed by separate enrolment or service terms communicated to you at the relevant time.

Use of the Site

You may use the Site for lawful, personal, and non-commercial purposes. You agree not to:

• Use the Site in any way that violates applicable law or regulation.
• Attempt to interfere with the proper functioning of the Site, including by introducing viruses, excessive automated requests, or other harmful code.
• Scrape, reproduce, or redistribute Site content in bulk without our prior written consent.
• Impersonate Eclat Institute or any of its staff in communications with others.

Interactive tools and calculators

The Site offers interactive tools, including JAE cut-off point lookups, L1R5 and ELR2B2 calculators, UAS-70 calculators, and study-plan generators. These tools are provided for general informational purposes only.

• Tool outputs are based on data and logic that may not reflect the most current admissions criteria, grading policies, or institutional requirements.
• We do not guarantee the accuracy, completeness, or timeliness of any tool output.
• You should not rely on tool outputs as the sole basis for academic, admissions, or career decisions. Always verify results with the relevant institution or official source.

Educational content

Articles, study guides, and other educational materials published on the Site are intended for general reference. While we strive to ensure accuracy, this content does not constitute professional academic advice and should not substitute guidance from qualified educators or official syllabi.

Intellectual property

All content on the Site — including text, graphics, logos, images, and software — is the property of Eclat Institute or its content suppliers and is protected by applicable intellectual property laws. You may view and print pages for personal, non-commercial use, but you may not otherwise reproduce, distribute, modify, or create derivative works from our content without prior written permission.

The Site may contain links to third-party websites and services (including WhatsApp for enquiries). We are not responsible for the content, privacy practices, or terms of any third-party site or service. Your interactions with third-party services are governed by their respective terms and policies.

Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the Site, you acknowledge that you have read and understood our Privacy Policy.

Forms, enquiries, bookings, and tool use

Certain features of the Site allow you to submit information to us, request that we contact you, join a waitlist, request a consultation, or use interactive tools. Where a form, button, or workflow is accompanied by a statement that submitting information or clicking the relevant button constitutes agreement to these Terms and acknowledgement of our Privacy Policy, your submission or click will constitute that agreement and acknowledgement.

If a particular form, tool, or workflow is accompanied by additional terms, disclosures, or consent language, those additional terms, disclosures, or consents will also apply to that specific interaction and will prevail to the extent of any inconsistency.

Submitting an enquiry, requesting a callback or consultation, joining a waitlist, or using an interactive tool does not by itself create any tuition or enrolment contract. Any tuition or enrolment is subject to separate enrolment or service terms communicated to you at the relevant time.

Disclaimers

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Eclat Institute disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components, or that any content is accurate or complete.

Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Singapore law.

Subject to the paragraph above, to the fullest extent permitted by Singapore law, Eclat Institute will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or opportunity, arising out of or in connection with your access to, use of, inability to use, or reliance on the Site, its content, or any tool output.

To the fullest extent permitted by Singapore law, Eclat Institute’s total aggregate liability to you for all claims arising out of or in connection with the Site or these Terms will not exceed the greater of (a) S$100 and (b) the amount, if any, that you paid to use the Site in the 12 months before the event giving rise to the claim.

Indemnification

You agree to indemnify Eclat Institute, its directors, employees, and agents against any third-party claims, losses, damages, liabilities, and reasonable legal fees to the extent arising out of or in connection with your (a) breach of these Terms, (b) unlawful, fraudulent, or abusive use of the Site, (c) infringement of any third-party intellectual property or other rights in connection with your use of the Site, or (d) introduction of malicious code or disruptive automated activity to the Site.

This section does not require you to indemnify Eclat Institute to the extent that the relevant claim arises from Eclat Institute’s own negligence, breach of these Terms, or wilful misconduct.

Changes to these Terms

We may update these Terms from time to time. The latest version will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

Severability

If any provision of these Terms is held by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision will be deemed severed or limited to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

No waiver

No failure or delay by Eclat Institute to exercise or enforce any right, remedy, or provision of these Terms will constitute a waiver of that or any other right, remedy, or provision. Any waiver must be in writing and will apply only to the specific instance and purpose for which it is given.

Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
